Dungeness Crab Trap Limit Program: Notice of Modifications to Text of Proposed Rulemaking

Pursuant to the requirements of Government Code section 11346.8 (c), and section 44 of Title 1 of the California Code of Regulations, the California Department of Fish and Wildlife (CDFW) is providing notice of changes made to proposed regulation section 132.1-132.5 of Title 14 of the California Code of Regulations which was the subject of a regulatory hearing on August 20, 2012.

The passing of AB2363 in 2012 amended the appeals process for the trap limit program as described in Section 8276.5 of the Fish and Game Code. The regulations were modified to incorporate these changes and to improve clarity and consistency. Necessity for these regulations and the justification for these modifications are provided in the Supplemental Statement of Reasons (SSOR) that were otherwise not described in the Initial Statement of Reasons notice on July 6th, 2012. The affidavit forms for the In-Season (FG 1303) and Between-Season Replacement (FG 1302) of buoy tags have also been modified to reflect updated costs and are included in this notice as well as the prior version of these forms.

Written Comment Period

Any interested person, or his or her authorized representative, may submit written comments relevant to the proposed regulatory action to Department of Fish and Wildlife. All written comments must be received by CDFW at the following office no later than 5:00 p.m. on February 4, 2013. All written comments must include the true name and mailing address of the commenter.
